1. Preamble

1.1. The privacy policy (hereinafter referred to as the ” Policy “) details your rights as well as our obligations with respect to the collection of certain personal information when you use the hypotek.com site (hereinafter referred to as the ” Site “), made available to you by Juriseo Technologies Inc. doing business under the name “Hypotek” (hereinafter ” Hypotek “).

1.2. The purpose of this Policy is to inform you of Hypotek’s practices regarding the collection, use and disclosure of personal information that may be obtained in connection with the services provided by the Site.

IT IS YOUR RESPONSIBILITY TO READ THIS POLICY CAREFULLY AND TO AGREE TO IT BEFORE USING THE SITE.

1.3. By accessing the Site or using its features, or by otherwise expressing your consent, you (hereinafter ” you ” or the ” User “) agree to be bound by the provisions of the Policy and the documents to which the Policy refers. This Policy is binding on you both during and after your use of the Site.

1.4. It is your responsibility to regularly read the entire Policy, as it may be updated at any time, and to systematically accept it before using the Site.

1.5. In order to use the Site, the User must also accept our terms of use (hereinafter ” Terms “) concerning his rights and obligations towards Hypotek.

2. What information does Hypotek collect?

2.1. On the site, the information collected is strictly relevant and intimately linked to the legal mortgages that are the object of the services for which you are dealing with Hypotek.

2.2. Hypotek may therefore collect the following information relevant to the services offered by the Site:

2.2.1. The personal contact information of a User or of a party involved in the mortgage file (such as a debtor, a building owner or any other person with an interest in the mortgage file, hereinafter collectively referred to as the ” Involved Party “);
Personal contact information may also include the following: first and last name, mailing address, lot number of your building in the official cadastre of Quebec, e-mail address and telephone number;

2.2.2. Where applicable, the name and contact details of the legal entity that the user is duly authorized to represent, as well as the user’s title within this legal entity;

2.2.3. If applicable, any judgment concerning a User and a Party involved;

2.2.4. Any claim between a User and a judgment;

2.2.5. The User’s personal signature.

2.3. Personal information will be collected by Hypotek in particular through the various forms that you will fill out on the Site, but also through in-house searches of various public registers, including the Land Register of Quebec and property assessment rolls, all in order to provide you with the services required through its Site.

2.4. Your credit card information will not be collected or stored by Hypotek. All information relating to your method of payment for services purchased on the Website will be processed by Stripe, an online transaction provider, and its suppliers. Hypotek has no control over, and assumes no responsibility for, their privacy policies or terms of use. Hypotek invites you to consult their privacy policies and terms of use by clicking on the hyperlink above.

3. What data collection method does Hypotek use?

3.1. Hypotek collects data relating to your browsing of the Site and your use of the services offered on the Site through the various forms and questionnaires to which we invite you to respond.

3.2. The User acknowledges and agrees that the data and information collected by Hypotek will be used to respond to requests for which the User deals with the Site. This will enable Hypotek to achieve the following objectives:

3.2.1. Issue legal mortgages and related documents;

3.2.2. Keep you informed of changes and updates to the Policy;

3.2.3. Improve the overall performance of the Site and optimize its presentation;

3.2.4. Ensure the integrity of the Site;

3.2.5. Update the cybersecurity procedures in place to ensure the protection of Site users’ data;

3.2.6. To obtain statistics concerning the services offered by the Site;

3.2.7. To offer the services for which Users have paid and to communicate information and data relevant to the efficient provision of these services to Hypotek’s third party partners.

3.3. It is also possible that data concerning you may be collected through your communications with Hypotek’s staff. Any communication you initiate with Hypotek or any of its authorized representatives for this purpose constitutes acceptance that data concerning you may be so collected and shared for these purposes.

3.4. The User acknowledges and agrees that Hypotek may communicate certain information relevant to the performance of the services for which the User has mandated Hypotek, including but not limited to the following parties:

3.4.1. Bailiffs, couriers and post offices to serve certain documents;

3.4.2. The agents responsible for the Land Registry for the registration of various documents in the Land Registry;

3.4.3. The registrar of various land registries in Quebec;

3.4.4. External lawyers to certify acts and answer legal questions;

4. Log files and cookies

4.1. Certain information may also be collected while browsing.

4.1.1. Your IP address;

4.1.2. The operating system used to browse the Site;

4.1.3. The pages you have visited on the Site, the orders and actions you have carried out;

4.1.4. The period of connection to the Site.

4.2. The collection of such data enables Hypotek to offer a personalized service according to your preferences and browsing habits. It will also be possible to maintain statistics to enable Hypotek to improve the services offered through the Site as well as its overall functionality.

5. Disclosure of your information to third parties

5.1. It is Hypotek’s policy to limit to the strict minimum the disclosure of information collected through through forms or through log files or cookies, for example. As such, Hypotek will not sell or rent your data to third parties for any purpose whatsoever.

5.3. However, please be advised that Hypotek reserves the right to disclose any information that has been collected during your browsing of the Site in order to ensure compliance with any legal requirements of our Terms of Use.

5.4. Within Hypotek, only authorized representatives will have access to information collected by the Site.

5.5. Certain service providers may also have access to the information collected if their services are required to ensure, among other things, the viability, functionality and security of the Site.

5.6. Apart from information transmitted directly to lawyers (external to Hypotek) in order to obtain legal advice regarding their situation, there will be no lawyer-client relationshipbetween Hypotek and a User,and no information transmitted to Hypotek will be qualified as information covered by professional secrecy.
For greater clarity, the only information considered to be confidential will be information sent directly to a lawyer (external to Hypotek) for legal advice, in which case the lawyer receiving the information will apply the standards of confidentiality incumbent upon him or her in accordance with his or her ethical obligations.

6. Safety measures implemented by Hypotek

6.1. The security measures put in place to ensure the continuity of the Site’s infrastructure and the protection of the information obtained are a priority for us. That’s why best practices for data protection and cybersecurity are in place to prevent any breach in the IT system deployed to store your data. However, no safety measure can guarantee that this objective will be achieved.

BY USING THIS WEBSITE, YOU ARE DEEMED TO ACKNOWLEDGE AND ACCEPT THE EXTENT OF THE RISKS TO WHICH YOUR PERSONAL INFORMATION IS EXPOSED.

YOU THEREFORE ACCEPT THAT IT IS POSSIBLE THAT THE SITE MAY BE SUBJECT TO CYBER-ATTACKS BY THIRD PARTIES OR MALICIOUS SOFTWARE WITH THE AIM OF ILLEGALLY OBTAINING YOUR INFORMATION.

TO THIS END, YOU WAIVE ANY AND ALL RECOURSE AND CLAIMS AGAINST HYPOTEK, ITS ASSIGNS, SUBSIDIARIES, AFFILIATES, DIRECTORS, SHAREHOLDERS AND EMPLOYEES IN THE EVENT THAT YOUR PERSONAL DATA IS STOLEN OR MISAPPROPRIATED ILLEGITIMATELY AND IN NO WAY ENDORSED BY HYPOTEK.

7. Access to Site information by users

7.1. Hypotek may grant a right of access to persons directly concerned by information obtained through the Site. All such requests will be evaluated and verified to ensure that they are well-founded, particularly in order to avoid any fraudulent situation.

7.2. The purpose of such access requests will be to allow consultation of such data, to request correction or even complete deletion by the User, subject to the data that must be retained by Hypotek to ensure the functionality of its services.

7.3. Users wishing to avail themselves of these rights should contact the person designated insection 11 of the Policy below.

8. Retention period of your data

8.1. All information, data and intelligence obtained through your use of the Site will be retained for as long as you use the services offered by the Site. Once the user ceases to use the services offered by the Site, the data will subsequently be retained for a period of seven (7) full years. Once this seven (7)-year period has expired, the information can be permanently deleted.

9. Changes to the Policy

9.1. Hypotek reserves the right to modify this Policy at any time without notice or further notice.

9.2. The User therefore accepts that this Policy may be altered from one visit to the Site to the next. The User is therefore aware that he/she must check the Policy each time he/she revisits our Site in order to be aware of any new changes that may have occurred. Continued use of the Site and its services, after an initial acceptance of the Policy, constitutes further acceptance of the Policy and any changes that may have been made since your last visit.
